Most E-Verify cases will receive a case result of Employment Authorized and will automatically be closed by E-Verify.
Action needed:
No further action is needed to resolve the E-Verify case.
Verification in Process / E-Verify Needs More Time
A result of Verification in Process means that DHS cannot immediately verify the data that was submitted for the case and needs more time.
Action needed:
- No immediate action is necessary.
- DHS will update most of these cases within 24 hours. Check back or refresh the case for an update.
Tentative Nonconfirmation (TNC)
When information submitted to E-Verify does not match the information SSA and/or DHS have on file for the employee, a tentative nonconfirmation can be issued. In some cases, a dual TNC can be issued, which means that the E-Verify case received a TNC from both SSA and DHS. E-Verify identifies which agency is associated with the TNC in the Further Action Notice.
TNC information is viewable in the E-Verify Detail Panel. Employers will see the steps needed to move forward with the case.
Action needed:
Employers are required to:
- Print or save a coy of the Further Action Notice (FAN).
- Confirm that the employee of the TNC has been notified.
- Select if the employee has decided to take action or not take action to resolve the mismatch.
- Referring the case means the employee intends to take action to resolve the mismatch.
- Not Referring the case means the employee has decided not to take any action to resolve the mismatch.
If needed, the case can be closed at this step. When closing employers will be prompted to select a reason for the closure.
If the employee has chosen to refer the case, you will be able to download or print the Referral Date Confirmation (RDC). You will also have the option to download the FAN again, if you need it.
E-Verify does not expect employers to provide a copy of the signed FAN but the employer is responsible for retaining a copy of it. If you choose to retain the copy in
, you can upload it to the Candidate’s File Uploads page.If the employee chooses not to take action on the TNC, you may terminate employment. The case can be treated as a Final Nonconfirmation and you should close the case in E-Verify.
If the employee does not give you their decision by the end of the 10th federal government working day after E-Verify issued the TNC result, you should close the case in E-Verify.
